§ 1 TERMS OF USE OF THE KASZUBSKAPERLA.PL STORE

1. These regulations define the terms and conditions of use of the kaszubskaperla.pl online store. Each user of the store is obliged to read these regulations and confirm this fact when making a purchase.

2. Unregistered Users of the store may purchase goods offered for sale at kaszubskaperla.pl. Orders placed by unregistered Users are subject to the terms and conditions set forth in § 2, paragraph 2 of these regulations.

3. Registration involves completing the form available on the store's website by providing the required data. Registration is completed when the store confirms registration via email sent to the User's address provided in the form.

4. Each User is required to complete the form truthfully. Detection of incorrect data will result in the account being blocked. Users can verify their data at any time if it changes.

§ 2 TERMS OF SALE

1. The sales agreement is concluded by the User (hereinafter also referred to as the Buyer) placing an order for goods displayed in the kaszubskaperla.pl online store and receiving confirmation from the kaszubskaperla.pl store regarding the availability of the goods. Confirmation is made via email sent from the kaszubskaperla.pl store to the User's email address.

2. The User may place an order as an unregistered User.

The Store allows the Customer to place an Order in the following manner:

a. The Customer adds the selected Product(s) to the cart.

b. The customer selects one of the offered payment methods (Payment to account)

c. An unregistered customer must independently complete the order form with the data necessary to conclude and execute the sales contract.

d. The Customer selects the method of payment for the price and other total costs of Order fulfillment indicated in the order form.

e. The Customer submits the Order using the Store functionality provided for this purpose.

f. Depending on the selected payment method, the Customer may be redirected to the website of an external payment service provider in order to pay the price.

g. In response to the Customer's Order, the Store shall immediately contact the Customer by telephone or send an e-mail to the e-mail address provided by the Customer for this purpose, confirming receipt of the order and acceptance of the offer submitted by the Customer or informing the Customer that it is not possible to accept it.

3. Orders for goods displayed in the kaszubskaperla.pl online store can also be placed by email or telephone. Orders are accepted at the email address and telephone number provided in § 7 of these regulations.

4. Orders placed via email should include a precise description of the ordered goods and their quantity. In response, kaszubskaperla.pl will notify the Buyer of the availability of the goods and send the Buyer information about the total price to be paid. The email will also provide the Buyer with payment instructions.

5. After placing an order by phone, kaszubskaperla.pl will send all the essential terms of the order, along with payment instructions, to the email address provided by the Buyer. The order will only be effective after the Buyer confirms their acceptance of the terms of the sales contract.

6. The store staff makes every effort to ensure that product availability information is current, i.e., consistent with actual inventory levels. However, kaszubskaperla.pl reserves the right that, due to the diverse nature of its sales, exceptional situations may arise where the availability displayed on the kaszubskaperla.pl online store website does not match the actual status. In such a case, the ordering party will be notified and will be able to modify the order by changing the product or the shipping time.

7. The colors shown in the product photos may differ from the actual product. Therefore, if you have any questions about the color, please contact the store via email. The difference between the color shown in the photo and the actual product is usually due to the individual parameters and settings of the viewer's computer monitor.

§ 3 PAYMENT METHOD AND DELIVERY OF GOODS

1. Product prices are listed in Polish zloty and include VAT. Prices do not include shipping costs, which will be indicated to the Buyer at the ordering stage, before payment. In exceptional circumstances (e.g., when ordering a large quantity of goods that will be delivered directly by kaszubskaperla.pl), shipping costs will be indicated to the Buyer in an email sent by kaszubskaperla.pl before delivery. Buyers can check shipping prices by visiting the "Order and Delivery" tab on the kaszubskaperla.pl website.

2. The payment method is selected by the Buyer from among the payment systems offered by the kaszubskaperla.pl store when placing the order.

3. Payment for purchases can be made using one of the following payment methods:

a) by bank transfer – to the bank account number indicated during the order processing process; the bank account number to which payment should be made is also provided in the "Order and delivery" tab on the store's website kaszubskaperla.pl and will be provided to the Buyer in the e-mail confirming the order;

4. The kaszubskaperla.pl store reserves the right to provide payment methods other than those listed in point 3, based on individual arrangements with the User.

5. Each ordered product is accompanied by a VAT invoice or receipt.

6. Shipping costs and any payment-related costs (e.g., transfer fees from the Buyer's bank) are the responsibility of the Buyer. The price list and delivery terms can be found in the "Orders and Delivery" section on the store's website kaszubskaperla.pl.

7. The purchased goods are delivered to the Buyer only within Poland in the following manner:

a) delivery via courier;

b) personal collection by the Buyer – the Buyer may collect the goods in person at the registered office of the kaszubskaperla.pl store, i.e. at the following address: Barnowiec 3, 77-140 Kołczygłowy;

c) delivery directly by the kaszubskaperla.pl store – such delivery is carried out based on individual arrangements with the Buyer and depends on the quantity/size of the purchased goods or the number of orders in a given region (the store combines deliveries to several Buyers).

8. The ordered goods, after confirmation of availability, are ready to be released to the carrier or the Buyer within 2 business days from confirmation of receipt of the order or posting of the payment to the bank account of the kaszubskaperla.pl store.

9. Estimated courier delivery time is up to 6 days within Poland. Delivery times for orders delivered directly by kaszubskaperla.pl are subject to individual arrangements with the Buyer. Personal pickup is possible after the kaszubskaperla.pl store confirms via email that the goods are ready for delivery.
Personal collection of goods is possible from Monday to Friday, from 9:00 a.m. to 2:00 p.m.

§ 4 WITHDRAWAL FROM THE CONTRACT BY THE CONSUMER

1. Buyers who are consumers, i.e. natural persons purchasing goods offered by the kaszubskaperla.pl store for purposes other than those related to their business or professional activity, do NOT have the right to withdraw from the sales contract within 14 days of the contract concluded with the kaszubskaperla.pl store, as all products are food products that do not contain preservatives and may be damaged due to improper storage.

§ 5 WARRANTY FOR PHYSICAL DEFECTS OF THE GOODS AND QUALITY GUARANTEES

1. The kaszubskaperla.pl store is obliged to deliver to the Buyer goods free from defects.

2. If the item offered for sale has defects, the kaszubskaperla.pl store will clearly inform the Buyer about the defects of the item.

3. If the Buyer reports defects after purchasing the goods, the kaszubskaperla.pl store, after approving the complaint, will replace the goods with new ones. If the goods are unavailable, the store will offer an exchange for another item or refund the Buyer's costs for the price and shipping, or reduce the price, at the Buyer's discretion. The Buyer should provide documentation of the defects, along with proof of purchase and a description of the defects, to the following email address: biuro@kaszubskaperla.pl.

4. The deadline for consideration of complaints is 14 business days.

§ 6 PERSONAL DATA SECURITY POLICY

1. The Administrator of Users’ Personal Data is GOSPODARSTWO ROLNE MATEUSZ GAWIN with its registered office in Borowiec.

2. The User provides his/her personal data voluntarily when placing an order.

3. The owner of the kaszubskaperla.pl store processes the User's personal data in order to fulfill the User's order placed through the store. Providing personal data by the User is voluntary, but necessary to fulfill the order. The owner of the store shares the User's personal data with payment operators and courier companies solely for the purpose of fulfilling the User's order.

4. The owner of the kaszubskaperla.pl store, with the separate and voluntary consent of the User, processes the User's personal data also for marketing purposes (sending the newsletter).

5. The User has the right to supplement, update, correct or discontinue processing if they are incomplete, outdated or untrue.

6. The User has the right to delete personal data or object to its processing only when it is used for statistical or marketing purposes, or when it was not used to make a purchase. Pursuant to the law, data related to a purchase cannot be deleted at the User's request.

7. By subscribing to receive commercial information electronically (newsletter), the User consents to receiving commercial information within the meaning of the Act of 18 July 2002 on the provision of services by electronic means (consolidated text: Journal of Laws of 2013, item 1422). The User may opt out of receiving commercial information electronically at any time.

8. In order to obtain information about their personal data, request their disclosure or deletion, the User may contact the Administration of the KASZUBSKAPERLA.PL store at the following address: biuro@kaszubskaperla.pl.

§ 7 CONTACT DETAILS

3. The cost of calls to the indicated numbers is in accordance with the price list applicable to the operator providing telecommunications services to the Buyer.

§ 8 FINAL PROVISIONS

1. In matters not regulated in these regulations, the provisions of Polish law shall apply, in particular the Civil Code and the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws, item 827).

2. These Terms and Conditions may be amended. Notice of any amendments to the Terms and Conditions will be posted at the beginning of the Terms and Conditions and on the home page of the kaszubskaperla.pl store and published for a period of at least 21 calendar days. Each registered User will be notified of changes to the Terms and Conditions via email 14 calendar days prior to the implementation of the amended Terms and Conditions. Users also have continuous access to the Terms and Conditions on the kaszubskaperla.pl website. Within 14 days of receiving the notification, the User may refuse to accept the changes to the Terms and Conditions by informing the kaszubskaperla.pl store or kaszubskaperla.pl by sending an email to biuro@kaszubskaperla.pl. Refusal to accept the Terms and Conditions constitutes a withdrawal from using the kaszubskaperla.pl store.

3. Disputes concerning complaints and Buyers' pursuit of claims against kaszubskaperla.pl may be submitted to the competent common courts. Buyers also have the option of using out-of-court dispute resolution methods, such as mediation or arbitration.
